BIOGRAPHY

Ryan E. Yagoda joined Kralovec, Jambois & Schwartz in August 2003. Ryan began his professional career in 1999 as an attorney at Ungaretti & Harris one of Chicago’s top 25 largest law firms. As a trial attorney at Ungaretti & Harris, Ryan defended a Chicago law-firm in a Federal Court legal malpractice case arising out of the law-firm’s failure to disclose experts in an $8 million personal injury trucking accident case.

He also successfully tried a case to verdict against two, Kane County doctors for failing to diagnose and treat a deep-vein thrombosis resulting in the death of a 55 year-old husband and father of two.

Ryan’s previous experience also includes drafting appellate briefs to the United States Court of Appeals for the Seventh Circuit and to the First and Second Districts of the Appellate Court of Illinois (civil and criminal). Some of his published opinions include Davis v. Loftus, 778 N.E.2d 1144 (1st Dist. 2002)(affirming the trial court’s holding that income partners are not partners under the Illinois Partnership Act; and People v. Youngerman, 800 N.E.2d 799 (1st Dist. 2003)(reversing the trial court’s denial of an independent psychiatric examination for a not guilty by reason of insanity acquittee).

Ryan has brought his diverse experience to Kralovec, Jambois & Schwartz where he has obtained over $50 million in verdicts and settlements for his clients in medical malpractice, product liability, and personal injury cases. In a fifteen month period between July 2008 and September 2009, Ryan obtained five jury verdicts in five different counties (Champaign, Coles, Knox, Fayette, and Will).

In September 2009, Ryan obtained a $1.5 million jury verdict in Will County for the death of a 77 year old woman who died following a laporascopic hernia repair surgery. The case involved a surgeon’s failure to timely recognize and treat a small bowel perforation that occurred during surgery.

Also in September 2009, Ryan secured a $3.25 million settlement against the City of Chicago for injuries sustained by a man after he was injured when his motorcycle crashed as a result of a large pothole on a City street.

In June 2009, Ryan obtained a record verdict in Fayette County on behalf of the family of a 77 year old woman who died from a subdural hematoma that was misdiagnosed after she fell on her driveway. The verdict was the highest medical malpractice verdict in Fayette County.

In April 2009, Ryan obtained a $500,000 verdict on behalf of a 32 year old veterinarian after her orthopedic surgeon improperly repaired a distal radius fracture of her left arm resulting in the potential need for a future wrist fusion. This was the first plaintiff’s medical malpractice verdict in Knox County since 1991.

In December 2008, Ryan secured a $3 million settlement against a Champaign Hospital. The case involved the failure to timely diagnose and treat hydrocephalus following surgery which resulted in the death of a thirty-one year old woman.

In September 2008, Ryan obtained a $2.38 million jury verdict in Coles County on behalf of a man who sustained a rectal-urethra fistula after he was negligently given an enema five days after undergoing a radical, retropubic prostatectomy. This is the highest jury verdict in the history of Coles County.

In July 2008, Ryan obtained a $2.1 million jury verdict in Champaign County on behalf of the Tuscola Chief of Police. The Police Chief sustained a skull fracture, three vertebral fractures, a separated clavicle, a rotator and bicep tear, and fractures of the small bones in his inner ear after falling down an empty stairwell when the Defendant removed the stairs without providing a warning or barricade. As part of the $2.1 million verdict, the jury awarded the Chief of Police’s wife $200,000.00 for her loss of consortium claim.

Also in 2008, Ryan secured a $1.4 million settlement from two physicians for failing to timely diagnose and treat a hip infection following hip replacement surgery that resulted in a spinal infection and paralysis. Ryan also reached a $1.2 million settlement with a Kankakee physician for his negligent performance of an L5-S1 posterior fusion which resulted in the need for two subsequent surgeries.

In 2007 and 2006, Ryan obtained over $12 million for his clients involving various complex medical malpractice, nursing home, and general negligence cases including the following: a case against one of the nation’s largest outdoor sign companies for injuries sustained when a cat-walk on one of the billboard signs collapsed causing permanent spinal cord damage; a case against a neurosurgeon for causing the death of a ten-year boy by failing to properly monitor and treat increased intra-cranial pressure following a fall from his bicycle; a case against a family care physician for the death of a Decatur man after his doctor failed to properly recommend and screen for colon cancer; a case against an emergency room physician for the death of a woman who presented with signs and symptoms of a heart attack but was sent home without a proper work-up; and a case against a nursing home for the death of a woman who called 911 from her room only to have the nursing home turn the ambulance away.

In October 2005, Ryan secured a $1.7 million settlement from a nursing home and hospital on behalf of a 71 year old man who was paralyzed from the waist down due to their negligence. The nursing home failed to stop the man’s Coumadin for three days prior to a medical procedure as ordered by his doctor. The hospital failed to confirm that the man was off his Coumadin prior to clearing him for the procedure.

In July 2005, Ryan obtained a $1.4 million jury verdict in a medical malpractice case for the family of a 44 year old woman who died from fungal meningitis after her family doctor failed to obtain a neurology consultation to diagnose and treat her. Also recently, Ryan secured a $700,000 settlement for the family of a nine month old who died as a result of his doctor’s failure to recognize the signs and symptoms of bacterial meningitis.

In January, 2005, Ryan secured a $1.3 million settlement in Cook County for the death of a woman who died from Cook County Hospital’s failure to properly treat her signs and symptoms of an ectopic pregnancy.

Ryan also assisted in securing a $3.75 million settlement in Sangamon County for a child who was born with cerebral palsy due to numerous physicians’ failure to timely intubate the mother who went into respiratory failure; and a $2.5 million settlement in Macon County for the death of a man who was given a lethal overdose of epinephrine in the emergency room after the man fell off his bicycle and fractured his nose.

In addition, Ryan helped secure a $750,000.00 settlement against a Hospital in Sangamon County for the death of a sixteen-year old child who died from a pulmonary embolism; and a $450,000.00 settlement for a four-year old boy who sustained facial fractures in an automobile/garbage truck collision.

In January 2008, after a successful trial, Mr. Sukhman obtained a settlement of $700,000.00 on behalf of a 75 year old man killed by a drunk despite the insurance company claiming that they would not compensate in the criminal case of a DUI.

In 2006, Mr. Sukhman secured an $800,000.00 settlement, after three days of trial, against a Springfield, Illinois hospital in what is believed to be the largest settlement for a wrongful death case in Sangamon County, Illinois.

In 2005, Mr. Sukhman obtained a $1,400,000.00 verdict against a local family physician in Monmouth, Illinois (population 8,500) on behalf of a 48 year old woman who died of an extremely rare disease, cryptococcal meningitis, after the woman’s doctor failed to timely notice the woman’s symptoms. Also in 2005, Mr. Sukhman was co-counsel in a case that resulted in a $1,450,000.00 verdict on behalf of an 82 year old man in Bloomington, Illinois who died when he was given unnecessary blood thinners. Both verdicts in 2005 were record verdicts for the respective counties.
